Domestications

Subpoena domestication for law firms, businesses & individuals

If your case is pending in another state and the witness or records are in California, your subpoena must be issued by a California court before it can be served. We prepare, file and serve domesticated subpoenas under California’s version of the UIDDA.

One request covers the whole process: the application, court issuance, service on the witness or business, and a proof of service you can use in your home state.

What is subpoena domestication?

Domestication turns an out-of-state subpoena into a California subpoena. California adopted the Interstate and International Depositions and Discovery Act at Code of Civil Procedure §2029.100 and following.

The foreign subpoena is submitted to the superior court clerk in the county where discovery will take place, with the required application and fee. The clerk then issues a California subpoena incorporating the original’s terms, which can be served like any other California subpoena.

Frequently asked questions

Do I need a California attorney?

Under the UIDDA, a California attorney is generally not required just to have the clerk issue the subpoena. Disputes over the subpoena may require local counsel.

Which county do I file in?

The county where the discovery is to be conducted — for example, where the witness lives or the records are kept.

What is subpoena domestication?

Domestication is the process of turning an out-of-state subpoena into a California subpoena so a witness or records custodian in California can be compelled to respond to it.

What is the UIDDA?

The Uniform Interstate Depositions and Discovery Act (UIDDA) is a law adopted by California and many other states that simplifies domestication. The California court clerk issues a subpoena based on the out-of-state one, without a new court case.

What documents do I need to domesticate a subpoena?

The original out-of-state subpoena and any related attachments. We take it to the clerk in the right county, obtain the California subpoena, and serve it.

How long does domestication take?

It depends on the county clerk’s processing time and how quickly the witness can be served. We give an estimate when you send the subpoena.
