Terms & Conditions
Effective date: [DATE] · Last updated: October 2026
These Terms & Conditions (“Terms”) govern your use of processserverla.com (the “Website”) and the process service, court filing, eFiling, court messenger, legal messenger, publication, domestication and related services provided by ProcessServerLA (“ProcessServerLA,” “we,” “us” or “our”) (the “Services”). By using the Website, submitting a request or paying for Services, you agree to these Terms. If you do not agree, please do not use the Website or our Services.
1. Our Services and no guaranteed outcome
We will perform the Services diligently, professionally and within the bounds of the law. However, the result of any assignment depends on factors outside our control, including the accuracy of the information you provide and the actions of the person or business to be served. We do not promise or guarantee any particular outcome, such as successful service, a specific completion date, the location of a person, or the acceptance of any document by a court.
ProcessServerLA is not a law firm and does not provide legal advice. Information on the Website is general information only. Please consult an attorney about your legal rights and obligations.
2. Eligibility
You must be at least 18 years old to order Services. If you are under 18, you may use the Website only with the involvement of a parent or guardian. We may refuse service, cancel orders, or suspend or end access to the Website at any time, for any lawful reason.
3. Your information and responsibilities
- You agree to provide complete, accurate and current information, including correct names, addresses and case details, and to tell us promptly if anything changes.
- You are responsible for the content of the documents you ask us to serve, file or publish, and for confirming that service is appropriate and lawful.
- You agree not to use our Services for any unlawful, harassing or fraudulent purpose, or to obtain information about a person for an improper purpose.
- If you believe someone has used your information or account without permission, contact us right away.
Incomplete or inaccurate information may delay or prevent completion of your assignment, may require additional charges, and may result in cancellation of your order.
4. Privacy
Our Privacy Policy explains how we collect, use and protect personal information and is part of these Terms.
5. Orders, quotes and payment
- A request submitted through the Website, by phone or in writing becomes a firm order once we confirm it with a quote, invoice or other written confirmation and you approve it or pay.
- Orders cannot be cancelled after work has begun unless we agree in writing. Charges for work already performed remain due.
- Charges are for work performed, whether or not service is ultimately completed. Additional attempts, stakeouts, skip traces, court fees, mileage outside the quoted area, rush handling and third-party costs may be billed as quoted or agreed.
- Payment card transactions may be subject to a processing fee of [CARD FEE %, IF ANY], where permitted by law and card network rules.
- All sales are final. There are no refunds, except where required by law.
By paying any invoice or advance, you confirm that you have read and agree to these Terms.
6. Communications consent
By providing your phone number and email address, you agree that we may contact you by phone, text message and email about your orders, account and Services. With your separate consent, we may also send occasional updates about our services; you can opt out at any time by replying STOP to a text or using the unsubscribe link in an email. Message and data rates may apply. Your consent to marketing messages is not required to purchase Services.
If you place an order by phone, text or email and we respond with an invoice or written confirmation that you then approve or pay, that confirmation reflects a firm order.
7. Reports and work product
Proofs of service, declarations of diligence, reports and other materials we prepare are provided for your confidential use in connection with your matter. You may file and use them as needed in your case, but you may not resell or publish them for other purposes without our written permission. You agree to indemnify us for claims arising from unauthorized use of our reports.
Information we obtain from public records and data providers comes from sources believed to be reliable, but we cannot guarantee its accuracy. Use of certain data may be limited by the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, the Gramm-Leach-Bliley Act and other federal and California laws.
8. Website content, copyright and trademarks
The Website and its content — including text, graphics, logos, page design, icons and software — belong to ProcessServerLA or its licensors and are protected by copyright and trademark laws. “ProcessServerLA” and our logo are our trademarks and may not be used without our written permission, including in meta tags or hidden text, or in any way likely to cause confusion. Other trademarks shown on the Website belong to their owners.
9. Permitted use of the Website
We grant you a limited, non-exclusive, revocable permission to use the Website for your own personal or business purposes. You agree not to:
- Copy, modify, resell or commercially exploit the Website or its content without our written consent.
- Use robots, scrapers or other automated tools to collect content or data from the Website.
- Frame the Website or use our name, logo or content to create a misleading impression.
- Upload viruses or harmful code, or attempt to disrupt, overload or gain unauthorized access to the Website or our systems.
- Collect personal information about other users, or use contact information on the Website to send unsolicited bulk messages.
Any unauthorized use automatically ends this permission.
10. Limitation of liability
To the fullest extent permitted by law, ProcessServerLA and its owners, employees, contractors and agents will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from the Website or the Services. Our total liability for any claim relating to an order is limited to the amount you paid us for that order. Nothing in these Terms limits liability that cannot be limited under California law, including liability for fraud, gross negligence or willful misconduct.
11. Indemnification
You agree to defend, indemnify and hold harmless ProcessServerLA and its owners, employees, contractors and agents from claims, losses, damages and expenses (including reasonable attorneys’ fees) arising from information or documents you provide, your instructions, your misuse of the Services or the Website, or your violation of these Terms or the law, except to the extent caused by our gross negligence or willful misconduct.
12. Disputes, governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising from these Terms, the Website or the Services will be brought in the Superior Court of California, County of Los Angeles, or in its small claims division where the amount qualifies, and you consent to that court’s jurisdiction.
If a payment is disputed or reversed (for example, through a chargeback), we may provide the payment processor or court with the order details, invoices, communications and work product needed to resolve the dispute.
13. Changes and severability
We may change the Website, our Services or these Terms at any time by posting an updated version on this page. Changes apply from the date they are posted. If any part of these Terms is found invalid or unenforceable, the rest remains in full effect.
